All purchase contracts and deliveries based on orders placed by our Customers via our online shop at https://poppyliine.shop (“Webshop”) shall be governed by these Terms and Conditions (“T&C”) in the version valid at the time of the order.
(1) The contract between the Customer and Atnode GmbH (“Atnode”, “us”, “our”) shall be concluded by offer and acceptance. The offer is made by the Customer and the acceptance of the offer is made by Atnode GmbH (the legal entity of the poppyliine.shop). The contract shall be concluded as described in paragraphs 2 and 3.
(2) The Customer may choose products from the range in the Webshop and select them by clicking on the “Add to Cart” button. By clicking on “Continue to Payment”, the Customer submits a binding offer to purchase the merchandise in the shopping cart. The Customer can change and view the data at any time before the final confirmation of the purchase. The final confirmation is done by our payment provider Stripe.com and reported back to our website. A purchase shall only be possible if the Customer has previously agreed to the Terms and Conditions.
(3) Atnode will send the Customer an automatic confirmation of receipt by email, stating the Customer’s order, for the Customer to print out. The automatic confirmation of receipt merely documents that the Supplier has received the Customer’s order and does not constitute acceptance. The contract shall only be concluded by our declaration of acceptance, which shall be sent by a separate email, or by sending the ordered merchandise.
(1) All prices in the Webshop are quoted in CHF, USD, EUR or GBP, based on the user chosen preference. VAT will be only shown, in case the Webshop transaction volume will pass the VAT-CH relevant threshold. Prices are subject to change
(2) The Customer shall be offered various payment methods which are managed by the payment provider stripe.com.
(1) In the event that the merchandise is temporarily unavailable at the time of the order and Atnode has already accepted the Customer's offer by means of a separate declaration of acceptance, Atnode will immediately inform the Customer hereof by email and reimburse any advance payment made without delay. Upon availability, Atnode will release the merchandise to a service provider for shipment within a few days.
(2) The Customer has the right to withdraw from the contract without setting a further deadline in the event of a delay in the merchandise shipment of more than two weeks after the declaration of acceptance by Atnode. Any payments already made by the Customer will be refunded by Atnode without delay.
(3) The delivery time shall be determined by the selected shipping method. Delivery shall be fulfilled by a shipping service provider independent of Atnode. The delivery periods stated in the Webshop represent approximate delivery times.
(4) Any risk of accidental destruction, accidental damage or accidental loss of the delivered merchandise shall only be transferred to the Customer at the point at which the merchandise is delivered to the Customer or at the point at which the Customer is in default of acceptance.
All merchandise delivered by Atnode remains the property of Atnode until payment has been made in full.
The Customer shall only be entitled to rights of retention insofar as its counterclaim is based on the same contractual relationship. Any set-off is only permitted with counterclaims that have been legally established or are undisputed by Atnode.
(1) The statutory provisions shall apply.
(2) A warranty shall only exist for the merchandise delivered by us if such a warranty has been expressly given; the statutory warranty claims shall remain unaffected by a warranty.
(1) Atnode hereby grants the Customer a voluntary right of return of 30 days from receipt of the merchandise. Under this right of return, the Customer can cancel the contract by returning the merchandise to Atnode within 30 days of receipt (the period begins on the day after receipt of the merchandise).
(2) Items must be returned in their complete original packaging. Replacements for lost original packaging must be procured by the Customer should the Customer wish to make use of the voluntary right of return.
(3) A timely dispatch shall constitute compliance with the time limit. In order to exercise the voluntary right of return, however, the Customer must as far as possible have merely tried the goods on for size, in like manner as in a shop, and return the merchandise complete, in its original condition, intact and undamaged, in the original packaging together with any instructions and - where present - with an undamaged seal. The return of goods may be refused if these requirements are not met. Compensation for loss in value may equally be claimed insofar as the loss in value is due to handling of the merchandise which was not necessary for the evaluation of the quality, characteristics and functionality of the merchandise.
(4) The statutory warranty rights shall not be limited by the voluntary right of return.
(5) Products which have been supplied in sealed packages for hygiene reasons where the seal has been broken, personalised items with embrodieries etc. as well as gift vouchers are excluded from the voluntary right of return.
Any refunds will automatically be made by Atnode to the account used by the Customer for payment. For payments made by PayPal or credit card, the refund shall be issued to the associated PayPal or credit card account.
(1) These T&C shall be governed by Swiss law.
(2) The place of jurisdiction shall be Zurich. Mandatory applicable consumer protection provisions remain reserved.
